Disclosure Notice in accordance with section 47A of the Fair Trading Act 1987 (NSW) These Terms and Conditions are important and you should read them fully. But there are some specific terms we wanted to make you aware of. These are set out below. Clause 2: Benefits – the extent of some Benefits available to you depends on whether you choose to opt in to receiving news and offers from Sony. You may opt out of these communications at any time. Clause 2(b) and Schedule: Certain products are excluded from the 30-Day Love It Or Your Money Back Guarantee and these may be updated or varied by Sony from time to time. In addition, your claim for a refund may be rejected if certain conditions aren’t met. The 30-Day Love It Or Your Money Back Guarantee is in addition to your rights under Sony’s consumer product warranties and your statutory consumer law rights as a consumer. You may still be eligible for an exchange, refund or repair even if the 30-Day Love It Or Your Money Back Guarantee does not apply. Under the Australian Consumer Law (Australian purchases) or Consumer Guarantees Act 1993 (NZ purchases), you are entitled to an exchange, refund or repair for faulty products and/or for products which do not satisfy the consumer guarantees under the Australian Consumer Law (Australian purchases) or Consumer Guarantees Act 1993 (NZ purchases). |
Introduction
Below are the terms and conditions for being a member of the MySony benefits program, which is open to residents of Australia and New Zealand.
By signing up to become part of MySony You are agreeing to:
1. these terms (“Terms”);
2. Sony’s Privacy Policy (Australia: https://store.sony.com.au/privacy-policy.html; New Zealand: https://store.sony.co.nz/privacy-policy.html) (which covers how Your personal information is used, collected, stored and disclosed);
3. Sony’s Website Terms of Use (Australia: https://store.sony.com.au/terms-and-conditions-of-sale.html; New Zealand: https://store.sony.co.nz/terms-and-conditions-of-sale.html) (which governs Your use of the Website); and
4. the Terms of Sale (Australia: https://store.sony.com.au/terms-and-conditions-of-sale.html; New Zealand: https://store.sony.co.nz/terms-and-conditions-of-sale.html) (which governs any purchases made by You as a MySony member).
1. Your participation and Membership
1.1 Participation in the MySony membership benefits program (“Program”) is open to individuals:
(a) residing in Australia or New Zealand with a unique and verified email address; and
(b) who have an Australian (in the case of Australian residents) or New Zealand (in the case of New Zealand residents) residential address.
1.2 Employees of Sony are allowed to participate in the Program.
1.3 Sony may, in its discretion, refuse participation in the Program where:
(a) You have engaged in, or Sony reasonably suspects on the basis of available evidence that You have engaged in, fraudulent or illegal activity relating to the Program;
(b) You have attempted to create more than one account for the same person by, for example, using multiple email addresses;
(c) You have provided misleading or deliberately incorrect information in connection with your Account; or
(d) it is reasonably necessary to protect Sony’s infrastructure, systems, data, security or assets and/or your personal information (for example where the Website and/or the Program is subject to a cyber incident or other unauthorised access).
1.4 By becoming a member of the Program You agree:
(a) to create and maintain, using a unique and verified email address (“Program Email”) an account with Sony Australia Limited (Australian residents) at http://store.sony.com.au or with Sony New Zealand limited (New Zealand residents) at http://store.sony.co.nz (“Account”). Companies or businesses may not create an account. Only one Account may be created per person. Creating more than one Account by using multiple email addresses for the same person is not allowed. Where You create more than one Account, any Benefits linked to such accounts will not be redeemable and will be cancelled, and Sony may terminate the additional accounts without notice;
(b) that You have read and understood these Terms;
(c) to the collection, use and disclosure of Your personal information in accordance with Sony’s privacy policy (Australia: https://store.sony.com.au/privacy-policy.html; New Zealand: https://store.sony.co.nz/privacy-policy.html) (“Privacy Policy”), as amended from time to time;
(d) that Your use of the Website will be governed by the website terms of use (Australia: https://store.sony.com.au/terms-and-conditions-of-sale.html; New Zealand: https://store.sony.co.nz/terms-and-conditions-of-sale.html) (“Website Terms of Use”); and
(e) that if You choose to opt in to receiving news and offers, You consent and agree to receiving marketing communications and related information from Sony. You may opt out of these communications at any time, however You may no longer receive a Birthday Voucher as part of the Benefits, and You may not be entitled to receive any future Benefits which may become available.
1.5 As a member of the Program, You must advise Sony of any change of name, address, Program Email or other details as soon as possible after the change. Sony is not responsible for any loss of any Benefits made available to You in connection with any failure by You to notify Sony of any change in Your details, except to the extent that this is caused or contributed to by Sony, its employees or contractors. Sony reserves the right to request acceptable proof for any change in details. Changes can be made by accessing Your Account (at http://store.sony.com.au (Australian residents) or http://store.sony.co.nz (New Zealand residents)) or by contacting the Sony Customer Service Team.
2. Benefits
2.1 The following are the Benefits under the Program and the terms that apply to them:
(a) Birthday Voucher - AUD / NZD $20.00:
i. You will receive a Birthday Voucher in Your birthday month if as part of becoming a member of the Program You choose to opt in to receiving news and offers from Sony when You create Your Account and remain opted in at the time of Your birthday month. You will also need to provide Your birth date to us when creating Your Account.
ii. You must have become a member of the Program prior to the month of Your birthday, otherwise You will not receive a Birthday Voucher until the following year. If you cancel your membership in the Program, and have already received a Birthday Voucher during that membership year, and then decide to join the Program again, you will not receive an additional Birthday Voucher. Only one (1) Birthday Voucher for each year of Program membership.
iii. Within 5 Business Days from the start of Your birthday month You will receive Your Birthday Voucher in the form of a unique code.
iv. The Birthday Voucher is a unique single use code valid for one order with Sony until the end of the month of issue, unless Your birthday falls after the 15th of the month, in which case it is available for use until the end of the following month.
v. The Birthday Voucher is only valid for a minimum purchase of $100.00.
vi. The Birthday Voucher will be applied at checkout.
(b) 30-Day Love It Or Your Money Back Guarantee
i. The 30-Day Love It Or Your Money Back Guarantee is available to You as a member of the Program if You create and maintain an Account. You do not need to opt-in to receiving news and offers from Sony to use the 30-Day Love It Or Your Money Back Guarantee. For clarity, Your Account must exist before You purchase Your Product(s) for the 30-Day Love It Or your Money Back Guarantee to be available to you in respect of those Product purchases
ii. As a member of the Program You may utilise the 30-Day Love It Or Your Money Back Guarantee for Products (except for the 30-Day Excluded Products (see clause iv below)) up to a maximum 2 Product purchases in any year (commencing from the time of Your first use of the 30-Day Love It Or Your Money Back Guarantee after creating Your Account).
iii. The 30-Day Love It Or Your Money Back Guarantee is in addition to Your rights as a consumer under Sony’s consumer product warranties and the Australian Consumer Law (Australian residents) and Consumer Guarantees Act 1993 (NZ) and Fair Trading Act 1986 (NZ) (New Zealand residents). The 30-day time period (and other Terms) for returns discussed in this clause does not apply to goods that are faulty or otherwise do not comply with one or more of the consumer guarantees under the Australian Consumer Law (Australian residents) or Consumer Guarantees Act 1993 (NZ) (New Zealand residents). Please visit Sony’s Warranty Page (Australia: https://store.sony.com.au/warranty.html; New Zealand: https://store.sony.co.nz/warranty.html) for information on Sony’s warranties for its products, and http://consumer.gov.au for information on the Australian Consumer Law and https://www.consumerprotection.govt.nz/general-help/common-consumer-issues/refund-replacement-repair/ for information on the Consumer Guarantees Act 1993 (NZ).
iv. The 30-Day Love It Or Your Money Back Guarantee is not available for the 30-Day Excluded Products. Sony may vary or update the 30-Day Excluded Products from time to time. Check for current list of 30-Day Excluded Products at the following link prior to purchasing Product(s): 30-Day Excluded Products. Any changes to the 30-Day Excluded Products do not impact any purchase of a Product(s) made by You and accepted by Sony (but not yet processed and/or delivered) in connection with this Benefit before the update takes effect. If You continue to use Your Account after the changes have taken effect, You are deemed to have accepted these changes.
v. To seek a refund on Your Product under the 30-Day Love It Or Your Money Back Guarantee You must start the returns process by, within 30 days from the invoice and shipping date, either:
1. commencing an online return claim by contacting the Sony Customer Service Team and arranging for Your Product to be returned to either:
(a) Sony’s central returns location in Australia or New Zealand at Sony’s cost; or
(b) Your nearest Sony Store at Your cost;
OR
2. return Your Product in person at Your cost to Your nearest Sony Store. Couriers or other deliveries to a Sony Store are not permitted.
The process and applicable terms for both options are set out in the Schedule to these Terms.
IMPORTANT: If You are returning Sony TV Products You must choose Option 1
(c) Free shipping on all purchases:
i. This Benefit is available if You have an Account. You do not need to opt in to receiving news and offers from Sony.
ii. All Product purchases made by You will be shipped to You free of charge.
iii. There is no minimum purchase value to access this Benefit.
2.2 In addition to its rights to cancel an order under the Terms of Sale, Sony reserves the right to cancel any order for a Product involving one or more of the Benefits where:
(a) You have engaged in, or Sony reasonably suspects on the basis of available evidence that You have engaged in, fraudulent or illegal activity relating to the Program;
(b) You have attempted to create more than one account for the same person by, for example, using multiple email addresses;
(c) You have provided misleading or deliberately incorrect information in connection with your Account; or
(d) it is reasonably necessary to protect Sony’s infrastructure, systems, data, security or assets and/or your personal information (for example where the Website and/or the Program is subject to a cyber incident or other unauthorised access).
Any fraudulent or illegal activity may be subject to appropriate administrative and/or legal action by Sony, including providing your personal information to law enforcement authorities where Sony is required to do so.
2.3 One or more of the Benefits may be used in the same transaction.
2.4 The Benefits may only be used by You and are not transferable. You may not sell, transfer of assign any of the Benefits to another individual.
2.5 The Benefits are not redeemable for cash.
2.6 In addition to changes to the 30-Day Excluded Products in accordance with clause 2.1(b)iv above, Sony reserves the right to vary, modify, limit or cancel the Benefits of the Program at any time. Subject to clause 2.7 below, Sony will use its reasonable endeavours to notify you about such changes as follows:
(a) in the case of minor amendments which do not adversely impact You, which are beneficial to You or where new Benefits are being added to the Program by Sony, by notice on the Website; or
(b) in the case of more significant amendments that may adversely impact you, by giving you at least 30 days’ prior notice at either the Website and/or to Your Program Email.
Benefits will remain available and unchanged during the relevant notice period, and any Benefits received during or before the notice period will remain valid for their time of use set out in clause 2 and in accordance with the terms applying at the time they were accessed / used. If You continue to use Your Account after the changes have taken effect, You are deemed to have accepted these changes.
2.7 In some limited cases, Sony may need to introduce a change more urgently without being able to provide prior notice. For example: (a) due to a change in law; (b) unexpected technical or operational issues beyond Sony’s reasonable control, or (c) where it is reasonably necessary to protect Sony’s infrastructure, systems, data, security or assets and/or your personal information (for example where the Website and/or the Program is subject to a cyber incident or other unauthorised access). If You continue to use Your Account after the changes have taken effect, You are deemed to have accepted these changes.
3. Termination
3.1 Sony may, in its discretion, suspend, change or terminate Your participation in the Program, where:
(a) You have engaged in, or Sony reasonably suspects on the basis of available evidence that You have engaged in, fraudulent or illegal activity relating to the Program;
(b) You have attempted to create more than one account for the same person by, for example, using multiple email addresses;
(c) You have provided misleading information in connection with your Account;
(d) You materially breach an essential Term which cannot be remedied;
(e) You materially breach an essential Term and (i) fail to remedy the breach within 10 days of receiving written notice (including over email) from Sony to do so or (ii) having commenced action to remedy the breach, fail to complete that action as soon as possible and in any event within 20 days of receiving written notice (including over email) from Sony to do so; or
(f) it is reasonably necessary to protect Sony’s infrastructure, systems, data, security or assets and/or your personal information (for example where the Website and/or the Program is subject to a cyber incident or other unauthorised access).
3.2 Where Sony intends to terminate Your participation in the Program, Sony will use its reasonable endeavours to provide You with written notice of this proposed termination to Your Program Email and You will have 14 days to advise Sony in writing as to why Your Account should not be terminated. Sony will take into consideration any response You provide and advise You of its decision. Your Account will be not be accessible during this 14 day period. Sony reserves the right to immediately terminate your participation in the Program without giving you the 14 day notice period referred to above where (a) Sony is required by law to do so or (b) where it is reasonably necessary to protect Sony’s infrastructure, systems, data, security or assets and/or your personal information (for example where the Website and/or the Program is subject to a cyber incident or other unauthorised access).
3.3 Any fraudulent or illegal activity may be subject to appropriate administrative and/or legal action by Sony, including providing your personal information to law enforcement authorities where Sony is required to do so.
3.4 You may terminate Your participation in the Program at any time by notifying Sony Customer Service Team for Australia or New Zealand (as applicable depending on Your country of residence).
3.5 Sony may terminate the Program at any time by providing at least 30 days prior notice. Sony will use its reasonable endeavours to provide You with this notice through the Website and to Your Program Email. All Benefits will remain available during the notice period, and any Benefits received during or before the notice period will remain valid in accordance with their time for use set out in clause 2, and will be subject to the terms applying to them at the time they were issued / utilised. In some limited cases, Sony may need to terminate the Program without providing at least 30 days prior notice. For example: (a) where Sony is required by law to do so; (b) due to unexpected or operational issues beyond Sony’s reasonable control or (c) where it is reasonably necessary to protect Sony’s infrastructure, systems, data, security or assets and/or your personal information (for example where the Website and/or the Program is subject to a cyber incident or other unauthorised access). In these cases, Sony will give You as much notice as reasonably possible in the most suitable way at the time.
4. Marketing communications
4.1 If as part of joining the Program You opt in to receiving news and offers, and later opt out of these communications by following the “unsubscribe” link or “update preferences” at the bottom of these communications, You will no longer receive direct email marketing communications from Sony.
4.2 If You opt out of receiving marketing communications, You will still receive service and transactions-based communications relating to Your participation in the Program (including, for example, order updates, communications relating to the 30-Day Love It Or Your Money Back Guarantee, and changes to these Terms, the Privacy Policy and Website Terms of Use).
5. General
5.1 A failure or delay by either Sony or You in exercising rights under these Terms does not constitute a waiver of those rights.
5.2 Nothing in these Terms affects any rights You may have and which by law cannot be excluded, including under the Australian Consumer Law (Australian residents) or Consumer Guarantees Act 1993 (NZ) and Fair Trading Act 1986 (NZ) (New Zealand residents).
5.3 Australian residents: These Terms are governed by and will be construed in accordance with the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of NSW and the Commonwealth with respect to any action or other legal process with respect to any matter in connection with these Terms. New Zealand residents: These Terms are governed by and will be construed in accordance with the laws of New Zealand. You submit to the non-exclusive jurisdiction of the courts of New Zealand with respect to any action or other legal process with respect to any matter in connection with these Terms.
5.4 If any part or all of any clause in these Terms is illegal, invalid or unenforceable then it will be read down to the extent necessary to ensure that it is not illegal, invalid or unenforceable, but if that is not possible, it will be severed from these Terms and the remaining provisions of these Terms will continue to have full force and effect.
5.5 Except in the case of the process for changes to the 30-Day Excluded Products (see clause 2.1(b)iv., changes to the Benefits (see clause 2.6) or termination of the Program (see clause 3.5), Sony may vary these Terms from time to time in its discretion. Where this involves a material change and/or it will have a significant impact on You, Sony will use its reasonable endeavours to provide You with prior reasonable notice of these changes at the Website and/or to Your Program Email. Sony may not be able to provide such notice where Sony needs to amend the Terms immediately. For example, where (a) Sony is required by law to do so; (b) due to unexpected or operational issues beyond Sony’s reasonable control or (c) where it is reasonably necessary to protect Sony’s infrastructure, systems, data, security or assets and/or your personal information (for example where the Website and/or the Program is subject to a cyber incident or other unauthorised access).
If You continue to use Your Account after the changes have taken effect, You are deemed to have accepted these changes.
5.6 In these Terms the single includes the plural and vice versa.
6. Definitions
In these Terms, the following definitions shall have the following meaning:
“30-Day Excluded Products” means the Products excluded from the 30-Day Love It Or Your Money Back Guarantee as set out at (30-Day Excluded Products) and as updated or varied by Sony from time to time in accordance with clause 2.1(b)iv.
“30-Day Love It Or Your Money Back Guarantee” means that part of the Benefits set out in clause 2.1(b).
“Account” means Your Program account that You set up in Australia (http://store.sony.com.au) or New Zealand (http://store.sony.co.nz) using Your Program Email, as defined in clause 1.4(a);
“Australian Consumer Law” means the Australian Consumer Law contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth).
“Benefits” means the discounts, products, activities, services, events or any other benefits offered or available to Program members from time to time, as set out in clause 2, which may be amended as notified by Sony from time to time in accordance with clause 2.6.
“Birthday Voucher” means the AUD / NZD $20.00 single use code forming part of the Benefits as set out in clause 2.1(a).
“Business Day” means any day that is not a Saturday, Sunday or public holiday in (a) Australia (for Australian residents) or (b) New Zealand (for New Zealand residents).
“Privacy Policy” means Sony’s privacy policy as defined in clause 1.4(c).
“Product” means a Sony product purchased from Sony, either through Sony Store Online or at a Sony Store location in Australia or New Zealand.
“Program” means the MySony benefits program under which customers receive certain Benefits for being a member as set out in these Terms.
“Program Email” means Your nominated email address in Your Account as defined in clause 1.4(a).
“Sony” means (a) (in the case of Australian residents) Sony Australia Limited, ABN 59 001 215 354, having its registered office at Level 7, 73 Miller Street, North Sydney, NSW 2060 or (b) (in the case of New Zealand residents) Sony New Zealand Limited, NZBN 9429039024756, having its registered office at Level 1, 100 Ponsonby Road, Ponsonby Auckland, New Zealand 1011.
“Sony Customer Service Team” means the customer service team of Sony available to be contacted at https://web.sony-asia.com/au/contact-us/
“Sony Store” means one of Sony’s stores located in Australia at Castle Hill, Chatswood or Parramatta (https://www.sony.com.au/microsite/sonystore) or New Zealand at Auckland or Christchurch (https://www.sony.co.nz/microsite/sonystore).
“Sony Store Online” means Sony’s online store in Australia (https://store.sony.com.au/) (Australian residents) or New Zealand (https://store.sony.co.nz/) (New Zealand residents).
“Terms” means these terms for the Program.
“Terms of Sale” means the Terms of Sale applicable to purchasing the Products from Sony at either https://store.sony.com.au/terms-and-conditions-of-sale.html (Australia) or https://store.sony.co.nz/terms-and-conditions-of-sale.html (New Zealand).
“Voiding Conditions” means the return conditions applicable to the 30-Day Love It Or Your Money Back Guarantee set out in the Schedule.
“Website Terms of Use” means Sony’s website terms of use as defined in clause 1.4(d).
“Website” means (a) for Australian residents http://store.sony.com.au or (b) for New Zealand residents https://store.sony.co.nz/, and, in case of either (a) or (b), any other site operated on behalf of Sony, as notified by Sony from time to time.
“You or Your” is a reference to the Program member in whose name the Account is created and held for the Program.
SCHEDULE – Your Return Options
IMPORTANT – returns involving Sony TV Products: Customers returning Sony TV Products must choose Option 1 below (online return). After creating an online return, You may choose to return it to (1) a Sony Store or (2) have it collected by Sony’s logistics carrier and returned to Sony’s central return location at Sony’s cost. |
OPTION 1 – submitting Your return online and sending Your product to Sony’s central returns location in Australia / New Zealand (or deliver it to a Sony store if You prefer)
1. Contact the Sony Customer Service Team in Australia or New Zealand within 30 days of the invoice and shipping date for Your Product to start the process:

2. The Sony Customer Service Team member will initiate the returns process by asking You for certain information in relation to Your Product purchase. This will include You being asked to send proof of purchase (such as a copy of Your receipt for the Product or PDF tax invoice) and photos of the Product for initial verification.
3. Once the initial review of Your claim has occurred, the Sony Customer Service Team member will let You know if additional information is required before Your claim progresses. When You have made all required information available, the Sony Customer Service Team member will let You know if Your Product has passed the initial verification, including that it does not appear to have any Voiding Conditions (as defined below), subject to final review when Your Product is received. If Your Product passes initial verification You will be issued with a unique returns reference.
4. Once all information has been received and the initial assessment is complete, You will need to return Your Product. You may return it one of 2 ways (the Sony Customer Service Team member will ask You for Your preference):
(a) Free collection from You from the place the Product was delivered (or an alternative nominated collection address) and delivery to Sony’s central returns location in Australia or New Zealand: if You choose this option You will receive an email to Your Program Email with the details of how to book Your return with Sony’s chosen logistics provider at Sony’s cost. You are responsible for all costs associated with removing the product from walls or other fixtures (for example TV Products affixed to walls or other brackets) before its collection by Sony’s logistics provider. The Product must be returned in full with its original packaging, accessories, components, paperwork, manuals and anything else included with the Product; or
(b) in person at a Sony Store: delivery or postage to a Sony Store is not permitted and You are required to present the Product in person at Your chosen Sony Store. You are responsible for all costs related to this delivery by You. The Product must be returned in full with its original packaging, accessories, components, paperwork, manuals and anything else included with the Product. You must also bring to the Sony Store a copy of Your proof of purchase and returns reference number. Sony is not responsible for any loss or damage that occurs to the Product during transport and delivery to Your chosen Sony Store.
5. Upon receiving Your Product (at Sony’s central returns location or a Sony Store) Sony will inspect the Product for any Voiding Conditions (as defined below), and to confirm that You otherwise comply with these Terms. If no Voiding Conditions exist, and You have otherwise complied with these Terms, You will be provided with a refund to Your original mode of purchase for the original price You paid for Your Product, less:
(a) if applicable: Products that have been purchased in conjunction with a Sony cashback offer will be subject to the cashback amount being deducted from the refund amount or Sony may void the cashback amount if You are yet to receive it (including Sony making these arrangements via a third-party provider administering the cash back promotion);
(b) if applicable: Products that have been purchased in conjunction with a Sony bonus offer (such as a gift with purchase) will be required to return the gift with their Product; and
(c) Sony reserves the right to charge an AUD / NZD $150.00 restocking fee for large or bulky items such as TVs. You will be informed before Your refund is processed if this restocking fee is applicable.
6. Please allow up to 10 Business Days for Your refund to appear.
7. Note: Sony reserves the right before processing any refund to request reasonable evidence from You where Sony reasonably suspects that the claim under the 30-Day Love It Or Your Money Back Guarantee involves fraud, anti-money laundering or other illegal activity, or to confirm that the products are not subject to any encumbrance or subject to any legal or equitable interest by a third party. Where Sony reasonably suspects the existence of one or more of these matters and appropriate evidence is not provided to alleviate Sony’s suspicion then Sony reserves the right to not provide a refund for Your Product under the 30-Day Love It Or Your Money Back Guarantee. Any fraud or abuse may be subject to appropriate administrative and/or legal action by Sony, and may require Sony to retain Your Product.
8. If Sony determines that Your Product is not eligible for a refund due to the existence of one or more of the Voiding Conditions (or that You otherwise don’t comply with these Terms) then the Product will be returned to You at Your cost.
OPTION 2 – directly returning Your Product to a Sony Store to process Your claim (not available for Sony TV products – must submit an online claim under Option 1 before dropping it off to a Sony Store)
1. Present Your Product at Your nearest Sony Store within 30 days of the invoice and shipping date for Your Product. You do not need to submit an online claim before hand. The Product must be returned in full with its original packaging, accessories, components, paperwork, manuals and anything else included with the Product. Sony is not responsible for any loss or damage that occurs when You transport the Product to Your chosen Sony Store. You are responsible for all costs associated with removing the product from walls or other fixtures (for example TV Products affixed to walls or other brackets).
2. You will need to have Your original proof of purchase available. For purchases made through Sony Store Online, You may log into Your Account and show this to the Sony Store staff member for this purpose.
3. The Sony Store staff member may ask You to verify Your Program membership by asking You to log into Your Account and presenting it to the Sony Store staff member.
4. The Sony Store Staff member will inspect the Product and confirm that there are no Voiding Conditions (as defined below) and that You otherwise comply with these Terms. In some cases, the Sony Store staff member may need to seek further advice before a final decision is made. Where this is required mutually agreed arrangements will be made with You (for example for the Product to remain with the Sony Store, under Sony’s responsibility, while further preliminary investigation is conducted).
5. If no Voiding Conditions exist and You have otherwise complied with these Terms You will be provided with a refund to Your original mode of purchase for the original price You paid for Your Product, less:
(a) if applicable: Products that have been purchased in conjunction with a Sony cashback offer will be subject to the cashback amount being deducted from the refund amount or Sony may void the cashback amount if You are yet to receive it (including Sony making these arrangements via a third-party provider administering the cash back promotion);
(b) if applicable: Products that have been purchased in conjunction with a Sony bonus offer (such as a gift with purchase) will be required to return the gift with their Product; and
(c) Sony reserves the right to charge an AUD / NZD $150.00 restocking fee for large or bulky items such as TVs. You will be informed before Your refund is processed if this restocking fee is applicable.
6. Please allow up to 10 Business Days for Your refund to appear.
7. Note: Sony reserves the right before processing any refund to request reasonable evidence from You where Sony reasonably suspects that the claim under the 30-Day Love It Or Your Money Back Guarantee involves fraud, anti-money laundering or other illegal activity, or to confirm that the products are not subject to any encumbrance or subject to any legal or equitable interest by a third party. Where Sony reasonably suspects the existence of one or more of these matters and appropriate evidence is not provided to alleviate Sony’s suspicion then Sony reserves the right to not provide a refund for Your Product under the 30-Day Love It Or Your Money Back Guarantee. Any fraud or abuse may be subject to appropriate administrative and/or legal action by Sony. 8. If Sony determines that Your Product is not eligible for a refund due to the existence of one or more of the Voiding Conditions (or that You otherwise don’t comply with these Terms) then the Product will be returned to You at Your cost.
Voiding Conditions
Under Options 1 and 2 above, if one or more of the following voiding conditions (“Voiding Conditions”) exist You will not be entitled to a refund under the 30-Day Love It Or Your Money Back Guarantee:
1. if the Product has not been installed, operated, maintained or used in accordance with Sony’s instructions or specifications provided with the Product;
2. if the factory-applied serial number has been altered or removed from the Product;
3. if there is damage, malfunction or failure resulting from alterations, accident, misuse, abuse, fire, liquid spillage, mis-adjustment of customer controls, use on an incorrect voltage, power surges and dips, thunderstorm activity, acts of God, voltage supply problems, tampering or unauthorised repairs by any persons, use of defective or incompatible accessories, the operation of a computer virus of any kind, exposure to abnormally corrosive conditions or entry by any insect, vermin or foreign object in the product;
4. if there is damage arising from installation or while moving or transporting the Product;
5. any third-party software or hardware not contained in the Product as originally configured by Sony has been added;
6. the Product has been serviced or altered by a third party during the 30-day period in which You used the Product; or
7. wear and tear to the Product from commercial, industrial, education or rental applications.
